Welcome to HeyReach! These Terms of Service ("Terms") govern your access to and use of the HeyReach website, platform, and related services (collectively, the "Service"). By using HeyReach, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or accessing our Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.
2. Description of Service
HeyReach is a unified messaging platform that enables businesses to send and receive WhatsApp and SMS messages, manage contacts, and run targeted communication campaigns through a single interface.
3. User Accounts
To use HeyReach, you must register for an account and provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. HeyReach is not liable for any loss resulting from unauthorized access due to your failure to maintain security.
4. Fees and Payment
- Pay-As-You-Go Model: HeyReach operates on a Pay-As-You-Go (PAYG) model. You purchase credits in advance ("Top-Up"), and your account balance is used for the services you consume (e.g., per-message fees for WhatsApp or SMS).
- No Subscriptions: There are no monthly or annual subscription fees. Credits do not expire.
- Usage Fees: Services are charged on a per-unit basis (e.g., per message sent). Rates vary by destination and service type. You only pay for successfully delivered messages; failed messages are automatically refunded to your credit balance.
- Payment Processing: All payments for credit Top-Ups are handled securely by our PCI-compliant payment partner, Stripe.
- Price Changes: HeyReach reserves the right to update its per-message rates, which will be reflected on the pricing page.
5. Acceptable Use
You agree not to misuse the Service. You must not use HeyReach to send spam, unsolicited promotional messages, or any content that violates laws, regulations, or third-party rights (including WhatsApp's Business Policy). You are responsible for obtaining proper consent from your contacts before messaging them. We reserve the right to suspend or terminate accounts engaged in prohibited activities.
6. Intellectual Property
All platform content, design, and features are the exclusive property of HeyReach. You retain ownership of your own data (contacts, message templates) created or uploaded within the Service. You grant HeyReach a limited license to process this data solely for providing the Service.
7. Termination
HeyReach may suspend or terminate your access immediately if you breach these Terms or misuse the platform. You may stop using the service at any time. Termination does not relieve you of any payment obligations incurred before termination.
8. Limitation of Liability
To the fullest extent permitted by law, HeyReach shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, resulting from your use of or inability to use the Service.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the Singapore courts.
